Welcome to FairShift Pro. Please read these Terms and Conditions of Use ("Terms", "Agreement") carefully before subscribing to or using the FairShift Pro software-as-a-service application, dashboard, related websites, and mobile apps (collectively, the "Service" or "Platform").

By accessing, signing up for, or using the Service, you ("Client", "User", "You") agree to be bound by these Terms. If you do not agree to all of these Terms, you are prohibited from using the Service.

  1. 1. Description of Service, Scheduling, & Mission

    FairShift Pro provides a visual shift management hub, scheduling grid, and automated operational platform. The Service allows corporate entities and administrators to build, modify, distribute, and manage complete employee work schedules across multiple shifts (e.g., Morning, Afternoon, Night).

    Integrated directly within this scheduling core is a built-in "fairness engine" designed to automate overtime (OT) compliance, track workforce shift histories, enforce consecutive workday thresholds (such as the 6-day or 7-day rule), and execute a top-to-bottom eligibility rotation for shift fulfillment.

  2. 2. Continuous Deployment, Updates, and New Features

    Frequent Enhancements: FairShift Pro is a dynamic platform that evolves rapidly. You acknowledge and agree that the Platform Owner updates the Service frequently, adding new features, modifying UI layouts, and rolling out software optimizations or compliance updates without prior notice.

    Beta Features: From time to time, new scheduling or automation components may be introduced as "Beta" or preview features. Use of these features is at your own risk, and FairShift Pro reserves the right to adjust, deprecate, or alter these updates at any time.

    No Feature Lock-In: Your subscription constitutes an agreement to use the Service as it exists at any given time ("as-is" and "as-available"). While updates aim to enhance scheduling efficiency, FairShift Pro does not guarantee that specific old interfaces or operational methodologies will remain unchanged indefinitely.

  3. 3. Accounts, Permission Levels, and Security

    To utilize the Service, you must register for an account. FairShift Pro relies on a multi-tiered permission system to enforce organizational boundaries and secure corporate assets:

    Owner (System Admin): Possesses global administration rights, including the ability to toggle a platform-wide "Kill Switch" (is_active parameter) to immediately revoke or restore account access to an enterprise or business unit.

    Manager (Company Admin): Governs company settings, manages billing, handles the configuration of active facilities, creates supervisor accounts, and administers master employee profiles.

    Supervisor (Shift Manager): Granted limited permission to view visual scheduling grids, manipulate designated team shifts, use automated notification shortcuts, and log overtime exclusively for their specifically assigned facility zones or operational units.

    Data Isolation: All schedules, operational structures, and employee data uploaded under a corporate profile are isolated using a distinct identifier (company_id), keeping each Client's database entirely invisible to external entities using the Platform.

  4. 4. Subscription Tiers and Facility Constraints

    The features, capabilities, and maximum facility capacities available to your organization are dictated strictly by the active subscription tier selected:

    Starter Plan: Provided on a complimentary ("Free") basis for small or single-site organizations. This tier restricts usage strictly to one (1) single operational facility. Schedule creation or template handling on this tier may be restricted to manual document or spreadsheet uploads.

    Pro Plan: Offered at a paid recurring rate. This tier supports standard distributed operations, permitting the creation, management, and tracking of up to ten (10) distinct facilities. It unlocks automated notifications, communication shortcuts, and integration options (including the WorkForce API).

    Enterprise Plan: Offered via custom corporate quotes. This tier is required for large-scale operations or complex logistical structures utilizing more than ten (10) facilities. It removes standardized structural caps and grants access to multi-site management frameworks and premium audit logs.

  5. 5. Billing, Trial Evaluations, and Suspension

    Automated Payments: Paid subscription tiers are billed automatically via credit card or an authorized payment processor (such as Stripe) on a recurring basis (monthly or annually).

    Free Evaluations: Select paid tiers may offer a 14-day risk-free trial. Upon trial expiration, access will automatically lock or freeze unless an eligible subscription tier is formally confirmed.

    Termination & "Kill Switch" Access: Managers may terminate their plan at any point. In cases of failed payments, structural violations, or explicit breach of these Terms, the Platform Owner reserves the right to trigger its global "Kill Switch" safety protocol, immediately locking out users and suspending data displays across all linked facilities.

  6. 6. Accuracy of Shift Data and Labor Compliance Disclaimer

    Operational Aid Only: FairShift Pro is designed to assist businesses with shift visualization, team distribution, and automated sorting parameters to prevent labor contract or scheduling rules violations (such as consecutive workday limit overages). The Service acts strictly as an operational aid.

    Client Responsibility: Platform automation relies entirely on the accuracy and structural fidelity of the scheduling records, attendance data, or API feeds synced into the database by the Client. The Client, along with its designated Managers and Supervisors, retains ultimate legal and operational liability for reviewing and publishing final schedules, allocating overtime hours, and maintaining compliance with local labor codes or collective bargaining agreements.

    Limitation of Liability: FairShift Pro shall not be held liable for any legal or labor grievances, financial penalties, regulatory fines, union complaints, or errors in payroll calculations resulting from the use of its scheduling grid, automated rotation engines, or continuous feature deployments.

  7. 7. Intellectual Property Rights

    FairShift Pro, its brand marks, scheduling components, visual grid layouts, underlying algorithmic engines, and software architecture are the exclusive intellectual property of the Platform Owner. Your active subscription grants you a limited, non-exclusive, non-transferable, and revocable license to access the application for internal business operations within your designated facility limits during the active term of the subscription.

  8. 8. Amendments to Terms

    FairShift Pro reserves the right to amend or replace these Terms at its sole discretion. For substantial modifications that impact platform usage, a minimum of 30 days' notice will be broadcasted to registered corporate Managers before the changes take effect. Continued use of the platform after an update timeline serves as complete acknowledgment and acceptance of the revised Terms.
